TERMS AND CONDITIONS OF SALE

1. TERMS AND CONDITIONS

The supply of all Goods by Lincraft shall be subject to these Terms and Conditions whether in the past, present or in the future. These Terms and Conditions shall prevail over any other terms and conditions including those implied by Statute to the extent permissible at Law. The Applicant acknowledges having read these Terms and Conditions of Sale prior to signing this Application for Credit Account.

2. CREDIT TERMS

Payment in full is to be made within 30 days of receipt of the goods. If payment in full is not received within these terms of trade, Lincraft reserves the right to withdraw credit and supply and interest may be charged at the rate of 15% per month or part thereof on any monies outstanding from the date of delivery of the goods.

3. DISPUTES

Any disputes with Lincraft shall be subject to the Laws and Courts of New Zealand.

4. WITHDRAWAL OF CREDIT

Lincraft reserves the right, at its sole and absolute discretion and without providing reasons, to withdraw any credit facilities granted, without prior notice.

5. DEFAULTS

If the Applicant defaults on any payments owed to Lincraft under these Terms and Conditions of Sale, all outstanding amounts (invoiced or otherwise) become immediately due and payable. The Applicant agrees to indemnify Lincraft against all costs incurred as a result of the default, including but not limited to solicitor fees (on a solicitor–client basis), commercial agent commissions, freight, insurance, loss of profit, and interest.

6. PAYMENT

Lincraft may, at its sole and absolute discretion, allocate any payments received from the Applicant toward any amounts owed by the Applicant, regardless of whether the Applicant specifies otherwise.
